Understanding Warnings & Cautions Labels.
As one would expect, Firestarters are volatile and sold as products that must be treated as hazardous when mis-handled or mis-used. Consumer Protection agencies in North America, which are tasked to regulate ignition products have mandated specific product performance standards be met and be accompanied by unambiguous label disclaimers for all Firestarters. The regulations are directed at primarily air quality and the consumer on the one hand, and call-outs regarding workplace hazards.
CalProp65 (the Safe Drinking Water and Toxic Enforcement Act of 1986):
Being the seventh largest economy in the world gives the state of California extraordinary clout in mandating consumer protection laws. Proposition 65 (CalProp65) became law in November 1986, when California voters through Initiative & Referendum approved it by a 63-37 percent margin. We mark compliance with the CalProp65 disclaimer on our packaging. However, the wording of the label applies primarily to the overall toxicity of Smoke derived from burning wood & coal ignited by any Firestarters.
SCAQMD (South Coast Air Quality Management District):
Under state and federal law, the South Coast Air Quality Management District (SCAQMD) is legally obligated to enforce all air pollution regulations that involve emissions from VOCs.
This requires manufacturers to contract with an independent, approved laboratory to analyze emissions and file a report for the approval of the SCAQMD Executive Officer. All of our products have been tested and meet the requirements of Rule 1174 – which is indicated on the back of our packaging as well as any Private Label retailers selling in California.
CAUTION & WARNING:
The average consumer would be hard-pressed to articulate the legal differences between them.
Warning indicates a seriously hazardous situation could arise using this product correctly in that could result in severe injury or even death (in the case of our products, the soot from charcoal burning). It is displayed prominently in an orange box with the words WARNING in all caps with an exclamation mark in a black triangle.
Caution indicates a far less hazardous situation could arise using this product which can cause minor or moderate injury. It is displayed in a yellow box with the words CAUTION in all caps with an exclamation mark in a black triangle.
